THIS IS AN AGREEMENT BETWEEN YOU OR THE ENTITY THAT YOU REPRESENT (hereinafter “You” or “Your”) AND Yourbooks (hereinafter “Yourbooks”) GOVERNING YOUR USE OF Yourbooks OF ONLINE BUSINESS PRODUCTIVITY AND COLLABORATION SOFTWARE.
Parts of this Agreement
In this Agreement all the “General” and “Specific Terms” are stated. “Terms” is used for representing the General Terms and the Specific Terms. If there arises a conflict between the General and the Specific Terms, then Specific Terms will be provided higher priority.
Acceptance of the Terms
You can accept the Terms under this agreement if you are of the legal age for acceptance. You must agree to our General Terms in order to use our Services. In case, you accept the General Terms but you don’t agree to certain Service Specific Terms, then you should not use that Service. You can accept the Terms and Conditions by checking the checkbox that seeks your acceptance for the Terms of Service.
Subscription to Beta Service
We may provide you with some Services as open or closed beta service (“Beta Service” or “Beta Service”) only for the sake of testing and evaluation purpose. We hold the supreme authority to determine the time required for testing and evaluation of Beta Services. We hold the full authority to judge the success of the testing and decision to offer the particular Beta Service as commercial service or not. If you subscribe to any Beta Service then you are not restricted to use any paid Service as a result of subscription of the Beta Services. We hold the ultimate authority to fully or partially discontinue, temporarily or permanently, at any time or from time to time, any of the available Beta Services with or without providing any notice to you. You agree that Yourbooks will not be liable to you or to any third party for any harm related to or caused by the modification, suspension of any Beta Services for any reason.
Modification of Terms of Service
We may modify the Terms any time by providing you with a notice either through service announcement or by sending an email to your primary email address. If we plan to make any significant changes to the Terms that can directly affect your rights, then we will provide you with a notice at least 30 days in advance about the changes by emailing at your primary email address. If the modified Terms affects your rights in any way with the use of concerned Services, then you can terminate your use of Services by sending an email notice to Yourbooks within 30 days of being notified about the changes in Terms. If such termination occurs then , you will be eligible for the refund of the unused portion of any prepaid fees. If you continue to use the Services after the effective date of any change then it will be considered as your consent to the changed Terms.
User Sign up Obligations
You can access the services provides by Yourbooks by signing up for a user account and providing all your necessary details. If you are working in an organization and you want to use the services for the organization, then various users from your organization can create their sign up forms by providing necessary corporate information of yours. If you are signing up in this situation, then we recommend you to sign up with your corporate email information. Once you sign up, you agree for the following:
- Providing authentic and true information for all the fields prompted in the sign up form
- Keep on updating your information to make your account accurate, true, and complete
If the information provided by you is untrue, inaccurate, outdated, or incomplete in any sense and if Yourbooks find any of your information untrue, inaccurate, outdated, or incomplete, then Yourbooks hold the supreme authority to terminate your account and you may be debarred from using any of the services provided by Yourbooks in the future.
Organization Accounts and Administrators
Once you sign up for an account with Yourbooks than you may specify one or more administrators for the same. The whole authority of managing and configuring the Services as per your requirements and managing the end users lies with the administrator of the organization account. If some third party user has made the organization account on your organizations behalf, then the administration authorities lies with that third party. If such situation occurs, then you should make sure that you have a proper agreement with the third part that specifies all the roles and authorities that the third party can avail of as being the administration for your organization account.
You are purely responsible for:
- Ensuring confidentiality of the password for your organization
- To make sure that you appoint competent person for managing the account of your organization
- To make sure that all the activities taking place with your organization account should comply with this Aggrement
You solely understand that Yourbooks is not responsible in any sense for the internal management and administration concerned with the Services of your organization account.
You are wholly responsible for making sure that you maintain the integrity of your organization’s administration account. If you lost control of your data for your organization account, then you can recover the control of your account by sending an email to email@example.com by specifying the process of recovery provided that the specified process is acceptable to Yourbooks. If you are unable to present any specific recovery process, then Yourbooks may provide the control of the administration account to an individual user who satisfactorily can provide the proof to Yourbooks on behalf of the organization. You agree not to hold Yourbooks liable for the consequences of any action taken by Yourbooks in good faith in this regard.
Personal Information and Privacy
Communications from Yourbooks
Once you agree to use some Service, then in addition to that it may also include certain communications from Yourbooks, such as service announcements, administrative messages and newsletters. These communications from Yourbooks is a part of using the Services. We give you the option to opt out of the option of receiving newsletters from our side if you wish so in order to get total privacy. But, in any case you won’t be allowed to opt out from receiving administrative messages or service announcements.
If any other person complaints against you with respect to your activities while using the Services, then we will forward the complaint to your primary email address. It is your responsibility to respond back to the complaint within 10 days of receiving it and you should also provide Yourbooks with the copy of your response. If you fail to respond to the complaint within 10 days then, we may disclose your name and contact details to the person who has issued the complaint against you to take any legal actions against you. If you don’t respond to the complaint within 10 days then it will be considered as your consent to disclose your details to the person who has issued the complaint.
Fees and Payments
You can avail of the benefits of various Services under various subscription plans. If you want to avail of the benefits of any services for less than a year then you can purchase that only via Credit Card. Once you start with a Service, your subscription plan will be auto-renewed at the end of the plan until you downgrade your plan. We will ask you beforehand in case you want to change the details of the Credit Card from which you are making payment. In case, you are not interested to proceed further with the subscription, you should inform this to us in seven days beforehand. In case, you don’t inform us that you want to downgrade your plan then Yourbooks will presume that you have authorized your consent to renew the subscription. You can click here to check the Refund Policy. We hold the supreme authority to change the price of any Services from time to time. If there is any increase in the charges then it will be applicable only after your current billing cycle.
Restrictions on Use
Once you agree to all the terms and conditions of this Agreement, you should not:
- Transfer the Services to any third-party user
- Use or post links of third-part website without agreeing to their terms and conditions
- Use the logo, company name, etc. of third party without their written permission
- Post any personal or confidential information of any person or entity without taking their consent
- Use the Services provided by Yourbooks that could damage, impair, disable, or harm any resources possessed by Yourbooks
- Violate any of the local, state, national, or international law
- Create any fake identity to mislead any person
Spamming and Illegal Activities
You agree that you are only responsible for the transmission of contents of the Services. You agree that you should not use the Services availed by Yourbooks for any of any unlawful, harassing, libellous, defamatory, harmful, pornography, obscene, or objectionable in any sense. You agree that you should not use the Services of Yourbooks to promote racism, malicious code, or infringe any intellectual properties of other. You agree that you should not use the Services offered by Yourbooks for transmission of junk mail, phishing, spam mail, or some chain letters. Yourbooks hold the ultimate right to terminate your access of Services anytime if you are found concerned with any illegal or unauthorized activities.
Inactive User Accounts Policy
If your account remains inactive from continuously 120 days, then Yourbooks hold the right to terminate the account of unpaid user accounts. The data linked with the inactive user accounts will also be deleted in such a case. In case of such event, we will provide you with a prior notice so that you can have the option to back-up your data, else it will be deleted. All the Services will be considered separately for the period of inactivity of user-account. In case, you keep one of your Services active, then it will not guarantee the activity of other Services used by you. If the user account is managed by more than one user, then it will not be considered inactive in case if one user remains inactive.
Yourbooks assure you that you own the content stored by you. You can use the Services of Yourbooks and we don’t hold any right to adapt or modify the content stored by you. But, you grant permission to Yourbooks to transmit and reformat your user account publicly only for the aim of providing Services to you.
User Generated Content
You can publish your own content by using the Services we offer but the consequences of its transmission and publication only depends upon you. The public content can be viewed by anyone on the internet and can be indexed by the search engines. It is your responsibility to make sure that you don’t publish any private content. You agree not to use or copy the content of other users of the same Services. In case you are using their content, you must have their written content to use it. If you are using the Services and you come across any copyright notices, then you should not try to remove them or disable them. If you try to hamper the rights of any third party with your content or there is some infringement, then Yourbooks hold the authority to block or remove your content.

Yourbooks will provide you with sample videos or files demonstrating you that you can can use the Services offered. The sample files or applications contain only random data for demonstration purpose. Yourbooks don’t provide any warranty for the information present in the sample files or applications.
Yourbooks, Yourbooks logo, the names of individual Services and their logos are trademarks of Yourbooks. You agree not to display or use, in any manner, the Yourbooks trademarks, without Yourbooks’s prior permission.
Disclaimer of Warranties
YOU AGREE TO USE THE SERVICES OF YOURBOOKS AT YOUR OWN RISK. THE SERVICES ARE OFFERED ON AS-IN-AND-AS-AVAILABLE BASIS. YOURBOOKS DON’T PROVIDE ANY WARRANTY THAT THE SERVICES OFFERED WILL BE TIMELY, SECURE, ERROR-FREE, OR UNINTERRUPTED. THE DATA OR ANY MATERIAL DOWNLOADED TO YOUR DEVICE WHILE USING A SERVICE WILL BE YOUR RESPONSIBILITY. IN CASE, SOME DAMAGE IS INCURRED TO YOUR DEVICE, THEN YOU HOLD THE WHOLE RESPONSIBILITY.
Limitation of Liability
WITH THIS AGREEMENT YOU AGREE THAT YOURBOOKS IS NOT RESPONSIBLE FOR ANY DIRECT OR INDIRECT DAMAGE OR LOSS TO YOUR BUSINESS OR INFORMATION IN ANY SENSE.
Suspension and Termination
If we find your account concerned with any illegal activities, or extended periods of inactivity, then we may suspend or temporarily disable your account pertaining to all the Services or part of Service. If you have any objections related to the suspension of your account, then you can contact us at firstname.lastname@example.org within a span of 30-days being notified about the suspension of user account. After a span of 30-days we may terminate a suspended or disabled user account. If you want to terminate your account then you can request us to terminate it.
If you have violated any of the Terms, then Yourbooks hold the right to terminate your user account for that Service. You hold the right to terminate your user account with Yourbooks in case you witness that Yourbooks breaches its obligations.
Once your user account is terminated your access to all the Services will be denied and all the information like your email address and password as well as the data will be deleted.
